New Ethics Complaint Filed Against Sarah Palin

Yup, it’s another one. I can hear the right wing side of the “chattering class” now. “What’s the matter with these people? She’s gone now! Haven’t they done enough damage? What more do they want? She’s stepped down from the governorship! Give it a rest!”

Which leads me to respond to these accusations that perhaps it wasn’t about Sarah Palin after all. Maybe…just maybe…it was about the principle of the thing. (Holding my breath and waiting to hear a little ‘pling!’ as a lightbulb goes off over the collective heads of Palin supporters everywhere)

Well, here is the latest from citizen ethics watchdog Andree McLeod.

Another ethics complaint aimed at holding Sarah Palin accountable has been filed with the Attorney General’s office by Anchorage resident and registered Republican Andrée McLeod. The document charges that Governor Palin has violated the Alaska Executive Branch Ethics Act for failure to submit completed and signed gift disclosure forms claiming gifts received by her and her family as specified by law.

“Governor Palin intentionally and willfully broke the Ethics Act by not claiming gifts timely, if at all,” McLeod said.

The Ethics Act is exceedingly and simply clear in that officials MUST claim gifts within 30 days of receipt. Yet, Sarah Palin states in a June 15th letter, “There are boxes of unopened mail at this point, even mail that was delivered in 2008. Thus, as initially disclosed, ‘we continue to open boxes’ and we consider any parcel “received” at the time it is opened.”

“The governor’s statement sets off alarms. Alaskans expect their public officials to follow the rules of law; especially the ones that are intended to keep them honest,” McLeod said. “Instead this woman admits to having no intention of complying with our laws.”

McLeod continues, “What possible reason is there for Palin to keep all these gifts a secret for so long? Why has she not disclosed them by the book now before quitting? ”

    I haven’t read all the comments yet, so this may have been covered, but it’s not exactly true that the complaints cost the filer nothing.

    While it is true that to file the actual complaint costs nothing, there are exorbitant costs to get the records requests filled to get the actual information which you have to provide to support your claim of a violation.

    Based on how much Linda’s records request cost, I’d guess Andree has probably laid out a fairly significant amount of cash.

    IMO, I believe it will turn on what the defintion of “received” is…the white vest for example, if she leaves it at the Mansion on display or what not…not a gift. Gift have to be over $150 in value. My age old obvious retort for these is: why is there not a staff person assigned to the reporting of gifts through the Gov’s office. The form should automatically “spit out” once she is handed a “gift” in excess of 150 in her role as the gov. In my office any gift over $10 has to be shared with co-workers or doanrted to charity.

    I’m sorry I’m too lazy to find the link, but someone on one of the other linked blogs posted a link to the actual documenta SP released at the last reporting period.

    In addition to having the donors actual checks become publically viewed including their address and in some cases phones numbers, there was a section about loans and obligations, and there was a statement about the ‘fact’ that the Palin’s had a legal debt from ‘frivilous’ charges.

    Aside from the misspelling, that was written in a different printing/handwriting than the rest of the document.

    That writing seems to match the text of the Thank You note. Chances are, SP did not write those notes, some staffer did.

    I have other questions about those disclosure documents but it’s very late here; tough to stay up, it’s been a long, long day, and I’ve got the sandman at my door … everybody sing along!

    She claims to have revamped the ethics rules, but they don’t apply to her. She is above them. If she were a responsible person who cared about her supporters, she would have had an assistant open all those boxes of mail in a timely manner. She would have claimed the gifts and answered the correspondences in a timely manner. Her ignorance of the basic rules of etiquette is appalling. She holds herself up as the elite of the elitists! She thinks she is superior to everyone else. None of the rules apply to $arah, not even the ones she made up.

    There was a little girl at a recent Presidential Town Hall who missed her last day of school to see the President.

    He wrote, on the spot, a note to the teacher asking him/her to excuse the little girl’s absence from class… that she was “with him” that day.

    She was VERY modest when the networks asked her to appear. She probably only did so because it was so publicly televised (he wrote the note right there at the TH meeting and gave it to her… cameras everywhere!).

    I’m sure if it had been a more “private” matter, she would have done nothing. (And her PARENTS would have done nothing.)

    This gushing adolescent is just looking for his own 15 seconds. Probably has nothing else going for him than a scrawled and haphazard note from a wannabe POTUS because he was dumb enough to send her a gift.

    This ethics complaint seems valid & AKM you are right, it’s really about the principal at times. Willful & blatant disregard of the law, how can that be justified? Maybe she thought the mail could be swept under her resignation rug, or kept in the wall safe with her crown. Governors must have employees, or maybe the secretary is one more friend from Wasilla. It just amazes me, all these scandals we hear about. Alaska, you deserve better.

    First, from what I remember reading, John Coale did more than chit-chat with SP at a cocktail party. Didn’t he help her set up her money-raising PACs? Perhaps he just hasn’t gotten around to billing her yet. Maybe. Just sayin.

    Isn’t there something fundamentally wrong with just changing your tweets? 😉

    I also think there was more to this than meets the eye. She was covering all for a multitude of things. “Thanking” people for keeping secrets perhaps?

    Costing the “taxpayers” money? Is she KIDDING? Aren’t the only real taxpayers in AK the ones who own great big oil companies? My understanding, from her own words during Hannity interview, is that AKn’s enjoy “negative” tax… they get back MORE than they put in!

    Sarah complained to her brother that she and her staff spend 80% of her time fighting the ethics complaints..she is obsessed with these complaints and spends way too much time talking about the people that complain about her ethics rather than talking specifically about each complaint and maybe try to defend herself with some facts…she brought her whole staff into her BS. I bet there will be some revelations about the Sarah Administration after she is gone from people close to the office of Gov.

    I do think it’s time to hold the Personnel Board accountable, in one fashion or another.
    The Palin Unleashed Victory Lap – misuse of state funds allocated to necessary travel. I don’t have time to figure out where she went, who the entourage was, so I’m rounding off reasonably.
    Eight trips in two weeks. At a minimum and probably more – Sarah, Todd, Ivy Frye, press person and one Senator for each trip. Let’s average $1,000 per person. Less for some – more for others. That would be airfare and subsistence.
    8 x 5 x $1,000 = $40,000. Minimum. That’s not counting chartered aircraft, catered lunches, miscellaneous expenses. Or salaries drawn for two weeks of being out of the office.
    So. $40,000 for state business? No. Not one of those trips was necessary to anything. For example, there was no justifiable reason for the PCE bill to be signed in Unalakleet; it wasn’t specific to that community. There was no purpose served in a tour of grizzlies in Katmai Park.

    I was really hoping that that would be #21.

    But enough fooling around. Parnell’s going to do the same thing. He’s already declared himself for a gubernatorial campaign, Sarah set precedent for use of state funds and property for personal benefit. He’s untouchable at this point. Whatever he does, he can point to precedence in the previous administration and that’s all he needs. Not only was there NO message sent, no lessons learned, but she gifted him carte blanche.

    Parnell will be the same blurring of church and government, the same keeping of secrets because us ordinary folk would misunderstand things, the same rationale and justifications. The same Seven Mountain Strategies agenda for state business.

    The entire personnel board has to go and there should be some dishonor to it, not to correct anything, but to establish a firm standard of accountablity and a little fear.

    I can see MANY cocktail and dinner parties where an attorney (while balancing a plate of appetizers in one hand and a stiff drink in the other) says something like “You ought to start a PAC. But be sure you do X, Y and Z in the set up to make sure it’s legit”.

    Or, for us more “common” folk: “I don’t think you should name your parents as executors of your will. Chances are you will outlive them and a secondary would have to be named.”

    Free advice and not NECESSARILY scandalous. HOWEVER, if this conversation were to take place in an office, with a lot of formality (an appointment, coffee served, an assistant taking notes), it might stand a better chance of being worthy.

    I dunno… I can see casual conversation as not necessarily a breach. But the other stuff? OH YEAH!

    ALSO, TOO: Let’s not forget the payroll issue Andree filed last week!!!!!!! Accepting payroll while campaigning and “supposedly” running the state via BB. If she could run the state via BB, why hasn’t she been on a beach in the Caribbean for the past 2 years, running AK from THERE? Also, too…. if running the state via BB, why the need for an ASSISTANT to travel the country with her? Can’t SP do it ALL?

    It’s not unethical for attorneys or anyone to provide a free service. It’s unethical of SP, as a politician, not to declare that she received it as a gift.

    I do agree that the IRS will be interesyed in ALL the gifts.

    Seems to me that she’s grandfathered in under the rules as governor regardless. If they arrived during her tenure, she’s obligated to follow the rules in place at that point in time. Frankly, I do not believe the claim that none of those boxes were or are opened. Maybe the kids opened them, but they’ve been opened. If she states otherwise, then my opinion is that (as usual) she is lying. Like a rug.

    If they weren’t reportable by SP then they weren’t reportable by the family, either. I’m not saying she DIDN’T have to report them–I don’t know. For all I know, the sea of pee-ers were telling each other to send gifts to “the best governor ever.”

    SP’s reasoning chip doesn’t seem to be working. Imagine trying to involve a military veteran, (or maybe she meant veterinarian) into her complaint. What does that have to do with someone questioning her conduct? She seems to manipulate, twist and include any honourable person(s), like her children, to gain sympathy. She would use the image of a noble Veteran as a “tool” to make her accusers feel guilty. She tries to turn her guilt back on to her accusers.

    Despicable.

    What’s false about the allegations? Did she indeed file the forms which Andree alleges are required to be filed? If so, then Palin has a point. If not, then it’s a valid complaint.

    Does Sarah Palin know there is a difference between an allegation based on a falsehood and an ethics complaint being dismissed because the relevant state agency is too lazy to actually investigate the allegation(s) contained therein? Or is she just engaging in political grandstanding?

    re #114: falls flat, but it seems to be a parody of Nixon’s “Checkers Speech”. He resigned as Eisenhower’s VP and then returned to politics with horrifying results. “Checkers” was a cocker spaniel puppy that did arrive as a gift for his little girls, Tricia and Julie, which of course they kept. The famous line not included in the above points out that his wife, Pat, wore a “good Republican cloth coat”, but of course that would NEVER suit Sarah, being a red leather kind of gal.

    Sue, I know that they changed the campaign finance laws last year, extending the statute of limitations because some members of the legislature couldn’t be dealt with because two much time had gone by. It was signed last summer. Not sure if any other ethics laws were strengthened as well.

    I would say ‘yes’ because none of us are above the law, though, it could be determined differently if they’re ethics complaints or criminal ones. If you steal money from a company, quit, and then work for another company, the first company can sue you even though you no longer work for said company.

    normally the mailbox rule applies in legal situations. meaning something is deemed “received” on the day it was mailed out – not the actual day it arrives. even if the mailbox rule didn’t apply, then it would be received based on the postmark of delivery.

    so in terms of her gifts, they were received long before she decided to open them.

    yes, if she sued in state court, it would allow the ethics complainant to offer a defense; request information/discovery; request her deposition; etc. the media would be invited, there could be a jury. but also, under what grounds would she sue? as far as i can tell, there is no provision for frivolous complaints in the Act. are there? if there aren’t, what could someone sue over? harassment? or disorderly conduct? weak. it would open up a can of worms. and we all know, as Sanford’s mistress would say, Palin would never be able to put the genius back in the bottle.

    I’m pretty sure the IRS has several definitions for “receipt” depending on which part of the code you’re in. I don’t know of any definitions that would use the date of mailing as receipt, though. Sometimes when the date at issue is the date at which a document, like a tax appeal, was FILED, the IRS will look at things like date of postmark, date of being stamped as received by the IRS office, etc.

    California has a Fair Political Practices Commission and they define “receipt” as when you have actual possession or control of it. Also, gifts are counted unless they are returned unopened, or donated to a charitable organization, within 30 days of receipt.

    One thing I was thinking was that Sarah’s (and other family members’) comments to the media about the gifts that have arrived might be called an admission of constructive “receipt” no matter what she says about the definition of “receipt” itself (a “constructive” act is something that doesn’t quite meet a legal definition but meets a kind of a common-sense defintion– like when an employer makes a workplace so hard to work in that an employee has no choice but to quit, that can be a “constructive” termination even if the person was never actually terminated by the employer).

    i think that this is a good complaint. services are harder to document, but the physical gifts raise a very good question. especially when she put herself on record and made up policy that “gifts are received when opened.” um, no they aren’t, based on the law. but god her tweets amuse me.

    someone should follow this complaint and file an amicus curiae statement as a concerned resident, documenting other governors (or other AK officials) who have done this and were accordingly prosecuted for similar actions…

    I have a couple of thoughts about this complaint; I think Andree would be more likely to be heard if she kept the complaint to (well, this complaint) to physical things whose value can be set.

    Coale’s so-called friendly suggestions do not fall under that umbrella. First of all, no one has claimed he has officially worked as a consultant or advisor; it’s been quite the opposite. So GVS & hubby both, would have to be “proven” as liars, as well as SP, to make that “paid advisor” label stick. Good luck with that one.

    However, the gifts that have been sitting in SP’s home are physical objects, that have or have had a price tag. GINO thinks that it’s okay to wait until each one is opened to declare it, but the USPS sees those items as received by the addressee ON the day they deliver ’em.

    More to the point, Alaska state law states that any gift must be declared within 30 days of receipt of said gift. GINO has stated herself that they have yet to be declared because they haven’t even been opened!

    quick version:
    1. Gift items not declared
    2. a. AK law states gifts must be declared within 30 days of receipt
    2. b. USPS sees those items as recieved at the time of delivery
    3. Palin has stated that many gifts have yet to be declared.

    There ya go, a no-brainer.

    But with Coale’s advisor status thrown in, it detracts from the bleedin’ obvious and gives [whoever] the opportunity to focus on that instead of the bleedin’ obvious.

    Further, any gift of value probably was dilivered with a proof of delivery (return receipt, signature, etc.) and that would prove the date of receip regardless of whether or not she opened it yet.

    Unfortunately the statute doesn’t define “receipt” in its “Definitions” section. Neither do the Alaska Administrative Code regulations on gifts. In most cases where the definition is not supplied in the specific statute or reg, the court would look at other statutes and regs and at the legislative history of the specific statute being applied. But I think that Sarah will claim that she can define “receipt” however she wants. I’m sure the Internal Revenue Service will have ITS own ideas, but they won’t affect the ethics charge, I don’t think.

    I would hope that on the day that $arah opens 80 boxes filled with envelopes and check$$$$, someone from the IRS is standing there, looking over her shoulder! It will be interesting to learn if the money is a personal gift if it was given before there was a PAC in place. (Coale might have told her not to open anything until he had a PAC in place, just thinking out loud).

    My other hope is a long shot. Maybe some of those checks dated 2008 have “expired” by now. My bank will not honor a personal check written more than 6 months ago. It would be poetic justice.     You know what gets me about Palin is the stupidity of her lies and misdeeds. None of them actually needed for any reason. Even this vest thing that they said they need to have a value set for is stupid beyond belief. Palin herself wouldn’t do it, because that would be a breach of etiquette, but her secretary simply calls the gifter and says “I need to have a value on the gift that you sent the Governor for reporting. We need this because by law we must report it.” Done, they give you a value, or estimated value, and you report it as the value as reported by the gifter. No etiquette breach, it takes what…15 minute phone call. This is just ridiculous. Same with Coale’s time, the secretary or a personal assistant, would ask him for a break down and report it as such. Not a big deal in any way.
    Making this stupid on her part.

    Certainly wish I’d sent a check in, then I’d have the Bank Record showing when it was cashed. I’m sure people who sent gifts already took the deduction. I mean, how else would they know when their gifts was ”received” by the Governor? It’s not like people are expecting Sarah to tell them.

    Her own letter, attached by Andrea to the complaint, stating when She considers them to be received, is admission of knowledge of when they should be reported. (there is no reason to make the statement unless prior knowledge of law)

    Not only a sustainable ethic’s charge, but also an etiquette fax pas. A cheerfully written thank-you note would be needed. The time frame for doing so is short. I don’t know exactly what it is, but certainly Emily Post would know.

    Or, perhaps she didn’t open the gifts but sent a thank-you anyway. “Thank you for your generous gift. Hugs and Kisses, Sarah.” If any such card could be located, it would substantiate the ethic’s charge and render her claim that a gift isn’t received until opened a glaring lie.

    Good questions that we have asked before and yet still have not been answered.

    Last we heard her father, Mr Heath stated there were 80+ boxes of mail & gifts waiting to be opened. Bristol got a ton of gifts too, if the reports are to be believed, for Trip.

    You have to wonder if any of this stuff has been reported, but even if some of it has, who is to know what has been reported vs what was actually received? Can we trust Sarah to be honest about it? Not if her history is to be believed.

    I believe it has been reported that some was sent to the Governor’s office and some to her home, dating back to the campaign, but how can anyone verify what was sent?

    Palin claims that she doesn’t consider it “received” until she opens it, but that certainly contradicts what the ethics laws state/require. She has certainly obtained enough cash to pay someone to sit and open/log all this stuff, and yet she hasn’t, and I do believe that she feels that if she just doesn’t open any of it until after she leaves her position that she will be able to keep it without any problems.

    According to what AKM wrote you have 30 days to claim the gift from the date of receiving it.
    InJuneau just said that she believes that the gifts were sent to Palin personally at her home in Wasilla. Some gifts were for the kids. However, Alaska law says that any gifts received for any family member, even including aunt, uncles, parents, etc, must be claimed.
    I don’t know of anyone that would be keeping track, so it seems that it would be easy to not claim them.
    I’m sure that the Palin supporters wouldn’t let a little thing like the actual Law get in the way of their worship.
    Sounds like Andrea is the one who is being stalked. Hope that any and all tweeters, blog entries, etc, are being monitored and sent to the FBI.
    Others have stated that they forward all threats to the appropriate agencies.

I say this because the Personnel Board has shown that they have no intention of considering ethics complaints as anything but “frivolous,” before they even read them.     AKraven–I believe someone noted that the IRS considers the date a gift is mailed to be its reportable date, so in their eyes, holding on to them will not solve her problem.

Perhaps this is what she is thinking- if she has thought it out. I wonder what the law says about this. Is a gift a gift on the date the gifter drops it in the mail, or when the recipient opens it. Most legal decisions come down on what the intent was. The gifter sent the gift to the Governor and so it must be claimed as a gift to her made when she was governor, no matter when she opens it.
