So Much for the "Palin-free Month"

You walk down the hall and turn into the kitchen. There you see me by the counter. My eyes fly open wide. I lean up slightly from a Pyrex pan. You see me with my mouth stuffed, barely able to close my lips together. “whut…” I manage to get out as crumbs of an unspecified baked good fall to the counter.

Yes, I am busted. And yes, by reading this post you’re the one who did it. I want you all to know, before I go on with this that I really did try. I walked past the kitchen for FOUR AND A HALF DAYS, as the aroma of brownies wafted out the door, looking like those little wisps of cartoon smoke that entice main characters, lifting them off the ground and drawing them like a magnet to the object of their desire. Four and a half days is something.

This was supposed to be a “Palin free month.” And I’m a good sport. I’m as tired of her as the next person. So, I gave it a shot. The first couple days were pretty good. But I knew that Reagan’s Birthday (aka ‘the holidays’) was coming up, and it might get harder. But this, I did not see coming.

In the last several months, Politics Daily has learned that the Palin family lawyer, Alaska attorney Thomas Van Flein, has filed applications to the United States Patent and Trademark Office to trademark “Sarah Palin®” and “Bristol Palin®.”

That’s right folks. Registered trademarks. The Palin brand has gotten bigger than the Palin’s themselves. While the application seems to be focused on the political and entertainment aspects of the Palin gals, how far away can we be from a Bristol Palin Dancing with the Stars action figure? Sarah Palin pumps? Or perhaps a line of American flags with ‘SPalin’ blazoned across the stripes? The possibilities are limitless as these two put their heads together to figure out how to brand themselves on a national level.  Even if they decide not to come out with a new fall line of endangered fur coats, or other Palinesque memorabilia, one thing is for sure. YOU can’t do it. There will be no making money by exploiting her name, unless you’re her.

The application is still pending for both Palin women. It seems there was a little problem. And even if I’d been able to resist the story to that point, I was helpless after this. They forgot to sign the form.

The current status on the Sarah Palin application indicates the patent office wants more information — specifically, it seems the application is missing Sarah Palin’s written consent to have her name trademarked. It is not known whether that issue has been cleared up. (snip)

Bristol Palin’s application has similar problems as her mother’s. It wasn’t signed and didn’t show her proposed trademark used in a commercial context. She must file examples that demonstrate how “Bristol Palin” is used in the actual sale or advertising of her “motivational speaking services in the field of life choices,” according to Bush’s letter to Van Flein.

Just like in school, you have to put your name on it, and give examples – particularly when your abject specialness now requires a trademark.

I hope that you will forgive my little slip into indulgence of the irresistible, and enjoy a brownie with me. Surely we’ll be able to go the rest of the month. Right?

    When will these two bloodsucking Palins disappear? The mother is talking about foreign policy, something she knows nothing of. The daughter fancies herself an expert in abstinence. As the church lady will say on SNL, “isn’t that special”. She opens her legs, conceives a child and now talks about abstinence. Talk about putting the cart before the horse.

    van Flein is working awfully hard turn Palin money into van Flein money. And he has moved to the lower 48 where he can pick up other suckers more easily than he could in Alaska.

    For the record, here’s what Palin told the Christian Broadcasting Network over the weekend regarding how the Obama administration has handled Egypt’s political upheaval:

    “Nobody yet has explained to the American public what they know, and surely they know more than the rest of us know who it is who will be taking the place of Mubarak and I’m not real enthused about what it is that that’s being done on a national level and from DC in regards to understanding all the situation there in Egypt.”

    Explaining further, she said: “And in these areas that are so volatile right now because obviously it’s not just Egypt but the other countries too where we are seeing uprisings, we know that now more than ever, we need strength and sound mind there in the White House.”

    Surely that’s a depth of analysis worth trademarking.

      I’m wondering if Missy Quittypants ® is under the impression that POTUS should come out and actually endorse someone to lead that nation? Heck, the Egyptian people haven’t even settled on which 4 or 5 (or 20!) people they’d like to see lead their country, and yet she wants POTUS to declare who the US wants to see lead them? Is she that clueless?

      Once again, I think she’s miffed that POTUS, again, hasn’t called her to get her expert opinion on the issue; she’d tell him who the US should endorse…after all, she endorsed O’Donnell, Brewer, Rand, etal. She knows all about endorsing people — not as leaders of sovereign nations, mind you, but she knows all about endorsing people who are good, xian, conservatives who love Amurica and small government and the entrepreneurial spirit and family values and yada, yada, yada TBag/R-rotes. I’m sure she has an Egyptian equivalent of Christine O’Donald in mind and wants POTUS to consult with her about making that dang endorsment! Now! beth.

        Every person who has a clue about the Egyptian situation have made it very clear that the US has very little power in driving the direction of the country. Failure to listen to Madeleine Albright, HIllary Clinton, and every other person of foreign relations stature is pretty indicative of the fish wife’s inability to gather and process information….

      Yes, that’s quite a diversion, the idea of having to use a trademark next to her name in discussions of her policies compared to, for example, Huck. And to be scared away by the threat of litigation if anything remotely negative is said. Kudos to Politics Daily (IIRC) for digging that up. I am pretty sure that Palin did not want this to get out right now.

      The world salad is hard to get through, but what I think she is saying is that it’s all the Obama administration’s fault that the right wing doesn’t have clear and simple talking points with which to blast the President’s Egypt policy.

  15. Suggestion for the month – if one MUST read a story about…who was that again? Anyway, also make sure you click through to at least two or three other stories of importance. I have noticed that there is a decreased mention of …. who was that again?….. in the list of most ‘popular’ stories on HuffPo as of late.
    Now, what were we talking about?

    There is more missing on the trademark applications than the signature.

    I posted on the Sarah Palin trademarking at MaliaLitman. It is a long comment, and the quote from the response from the US Patent and Trademark Office is long and full of official wording.
    Basically the required proof is missing to prove that she was engaged in the activities claimed when she claimed. The proof is required to issue the trademark. A shorter quote from the official response is:

    “In this case, the specimen submitted for the “Information about political elections” is a news story on the Fox® Network about Ms. Palin. The specimens submitted for the “Providing a website featuring information about political issues” are postings on Facebook®. The specimen does not show use of the mark as “providing a website featuring…”. Rather the proposed mark merely appears as a posting name.

    None of these specimens show use of the mark SARAH PALIN in relation to the services specified of “Information about political elections” and “Providing a website featuring information about political issues”. Therefore, applicant must submit the following:”

    Teacher marks a big red I for INCOMPLETE and says to follow the directions.

She could have made a fortune writing a book about Palin by revealing what Palin had said or done behind closed doors, but I bet she was forced to sign a non-disclosure contract and recieved a lot of money in doing so. She must still be dedicated to Palin because she could still have inadvertantly leaked information to a friend that would somehow get leaked to the press by some unknown 3rd person.

    But it could be that anyone who even uses her name will have to compensate, or be liable to be sued. Not just selling things or misrepresenting ownership of a Facebook page. IE, she could charge that someone misrepresented what she said (if they could figure it out in the first place, that is), because she is patenting the idea that she is a political analyst. Don’t know, am not a legal eagle.

    You know, I had decided to pretty much stop paying the slightest bit of attention to the Palin circus act, 2010 version of the TV show “Queen for a Day” crossed with “The Real Housewives of..whatever” crossed with the Geraldo/Greta coverage of OJ and Kato Kaelin during the “trial of the century.”. Then today I encountered this in “City Journal”, which I recommend perusing, and then wandering through comments. This is a serious, albeit conservative, publication with lots of intelligent insight. But here’s how this tale is living on due to the lack of due diligence by our major media. She’s still being taken very seriously as the modern take on feminism. !! This makes me crazy.

      What drives me crazy is that the “conservative women” held up as role models in the article are dogmatic, rather under-educated women who follow the party line, unable or unwilling to do much other than provide sound bites. Those most like Sarah are true originals, blazing new intellectual paths to the glory of the nation. They seem more like puppets put forth to attract the female vote. Most, but not all, seem to fall into the “eye candy” category. The others simply shore up the female presence on the right, but are not as popular as the purported “cuties.”

      I am not contending that there are no intelligent, thoughtful women on the right, but I am admitting that I have yet to see any on the forefront of their movement.

      That conservative women are still looking to her as a role model for anything just fries my posterior. I am continually amazed that Palin is being held up as a conservative feminist leader while her supporters bash the women who are truly working for the rights of women and children.

      Palin is an uneducated, egomaniacal nutjob who has quit every job she’s ever had AFTER causing substantial damage (usually financial). She has proven over and over again that she cannot run anything, from a family business to a small town of a few thousand people to her own family. She has no understanding of ANY of the issues affecting the country or the world, and depends completely on her looks, her snark and some snotty phrases written by other people. The fact that anyone can consider her a viable candidate for anything beyond cheerleading coach proves that the gains that women worked so hard for during the last 5 decades have been tossed aside in favor of a bumpit and some red f-me pumps. She is a pathological liar who is continually allowed to repeat her lies despite concrete proof that much of what she says is complete fabrication.

      What makes me angriest is that the knee-jerk selection of Palin as VP candidate (and therefore as presidential replacement) and now as a possible candidate for POTUS has reduced the image of powerful, smart, hardworking women in government to a joke. SHE is the reason that the Sharron Angles and the Christine O’Donnells and the Jan Brewers were not laughed out of their first campaign stops. She has reduced our most cherished and respected political process to just another freakin’ beauty pageant where education, hard work and competence are unimportant as long as your skirts are short enough and you can wink at the rich old white men.

      If I was a conservative female politician who had gotten an advanced education, worked hard and made sacrifices to achieve my goals, I would be furious at how Palin’s presence in politics has effectively cheapened my accomplishments.

    Queen Sarah. Oh yes, Bristol, why her own brand of birth control
    pills and/or devices. Maybe a line of dancing shoes, as she definitely
    is a Ginger Rogers when it comes to dancing. Yes, the PALIN BRAND…
    greed all the way to the banks. Ignorance and stupidity pays the bills
    for the Hillbilly Palins. While the rest of America works for an honest

    Nooooo! I thought I was safe here. I’m almost done with Chapt 1 of my thesis and I really need to get a draft of Chapt 2 to my committee. A whole month free from whats-her-name is such a blessing. So no more daily googling her; no more perusing the other watchdog sites or Huluing the comedy shows that often provide such hilarious commentary. It’s been an adjustment but I’ve convinced myself that if something really huge happened I’d see it through my daily check in with Mudflats. That’s all I’m allowed. OK-I did cheat and watched the Reagan thing last night. Ahh – but that was it! One slip up then back on the wagon this morning. So now I’m torn! I’ve not read this article. Is it really huge? I am going to try shielding my eyes and backing out slowly. Arrrg, I will not google her name! I will not google her name! I so have PDS.

      I don’t have links but I have read and heard about other schools/communities across the country including Michigan where she has been asked then refused/denied, stemming from money (can’t afford her) or the students/public don’t want her. Especially since Bristol has entered the fray when it comes to MSU. There are so many single mothers (across the world!) who have and are making it on their own.

          No, Nothing new, unfortunately. Still, it is a rather unexpected claim to make and so I would assume Mercede would have some pretty strong evidence. Why would a teenager attempt attempt to become pregnant when it is easy enough to do by accident. 🙂
          I suspect this is just another way to become some poster child for something, (but seriously advocating abstinence?) She seemed inordinately miffed not to be paid to speak about “abstinence in the university environment”- two things she obviously knows nothing about. But then, unjustified self-promotion tends to run in the Palin family.. She has already tried out the television dance star routine, now she plays the part of a spokesperson for teen mothers. What else does she have to write about?

Even what a 40-year-old ghost writer could say on behalf of a 20-year-old is beyond me, particularly since the public is only going to be interested in the last three to five years of her life.

      Why anyone, including Sarah Palin’s fans, would buy it is also beyond me. What wisdom and insight would they expect Bristol to have that her mother doesn’t? She hasn’t had a separate life of her own yet.

      I’m not an author or a major book purchaser, but I thought William Morrow & Co (not Morris) was a reputable publisher. Google says it’s part of HarperCollins. It figures.

          Megan is well.educated, Columbia IIRC, she was on the campaign trail, she had a lot to say and they said a lot to her re her moderate views. She didn’t win her fame by becoming an unwed mother, helped by free federal health insurance, going on DWTS looking like a combination of a moose sausage and street gal decked out in those pathetic costumes. She uses her kid to get money, while preaching not to have a kid. Really, there is no similarity in the 2 young women. .One is a wasilla hillbilly trying to get rich no matter how, and the other is a thoughtful, articulate young gal who doesn’t have to resort to talking about “middle fingers” when she gets near a mike.

          I’m a lawyer with some limited trademark experience. Here are some of my thoughts. (Please don’t rely on these thoughts as if they constitute legal advice; they do not):

          Basically, trademark law protects against confusion in the marketplace–that’s essentially it.
          Thus, for Sarah Palin or Bristol Palin to successfully sue under trademark law, they would have to convince a jury that the use of their names (i.e., their marks) likely caused confusion in trade.

          What kind of confusion do I mean? Essentially, I mean confusion about whether Sarah Palin or Bristol Palin actually created, marketed, or endorsed something in trade. So, for example, lets say I market a product representing a pregnant dancing piglet with lipstick and I label my product “Bristol Palin” She could not successfully sue me for trademark infringement without proving that my use of the label “Bristol Palin” likely caused consumers to believe my piglet product was actually Bristol’s piglet product or endorsed by Bristol (i.e., confused as to whose product it is).

          All freedom of speech considerations aside, I find it hard to believe a jury would find that the use of the Palin names in a Tina Fey routine or that photoshopped image caused confusion in trade. (Though I would just love to see the Palins and their legal teams try to argue and prove it).

          Wow, wouldn’t it be fun to add a warning label to my imaginary piglet product. “WARNING TO THE POSSIBLY CONFUSED: This piglet is NOT an official Bristol Palin(tm) product. The piglet’s name and obvious resemblance should NOT be construed as a endorsement from anyone, least of all Bristol Palin or her mother. Also, the producers of this product thought about seeking Bristol’s endorsement, and we discussed it with our families and prayed on it also. One of our family members said G-d told him that G-d was gonna tell Bristol not to endorse it. Also we figured anyway, who could afford to pay for a Bristol Palin endorsement?”

      Generally, trademark/copyright of ” person’s name ” is treated as a brand, the name by itself in this situation is common, thus requires some sort of design and/or specific usage. The name itself can be used by anyone if it does not infringe or copy(cat) the org. copyright/trademark documented use of. Say for example: S Palin ( with an offset red color line going from the bottom of the ” P ” to the end with a heart shape end ), that is unique in design. If that is the specific documented branding it could not be copied or be used, but, S Palin by itself could, S Palin with a big blue circle around the name could, yet simply changing the original design line color alone would be too much of a likeness. I deal with issues like this off and on under my business and I’m aware of the vagueness of my examples, anyone with basic knowledge will be quick to point out the lack of detail. I’m clarifying that just using the name, say you want to name your child S Palin will not result in legal issues or if mudflats use her name in articles, headers etc. Now, if the specific branding logo is used there could be legal issues, however, being a public figure would loosen right of use some, it also depends on if she is using the brand under “private” conditions: paid speeches, book cover title, closed door, or limited or no media access. Basically, the copyright works similar to a band, or book author. If I have confused anyone further ” I’m SooooRRRyyyyy”, this subject has many can/can not do conditions. This will not prevent spoofing or restrict protest signs…long as the very specific and detailed submitted logo/brand trademark or very similar in likeness is not used ( without permission ). Also note: for profit – not without permission, not for profit – fair use – can be used in most cases.           Its probably to prevent people using her name in business/other forms of for-profit. e.g. Sarah Palin or Sarah Palin Inc. If protected, then someone could not setup a business using her name: “Sarah Palin’s House of Pancakes”, “Sarah Palin Bakery” or say I want to setup a fund for the much needed education of SP or private education based learning center, I could not use “Sarah Palin EduMkation Fund”, without permission and likely even though the fund would benefit her greatly, she could ask for a percentage on top of what would be given to her anyway….similar to music royalties. The name itself can still be used for the most part under fairuse. However, knowing her, she’ll attempt to sue anyone she can once her current money making brand dies down. Trade/service marking one’s name doesn’t make much sense to me. If Sarah Palin were to start the “Sarah Palin Foundation” for the purpose of making speeches purporting to provide educational or entertainment services on politics, international affairs, etc., I could understand protecting the name of her foundation but her name ???? She could use brochures or web pages or advertisements of her foundation or perhaps texts of a speech or two as “specimens” for the Patent Office. I think advertisements could be included.             Based on political, constitutional & historic factual mockery coming from several fuzzy-logic individuals and political party’s, education appears to be defined differently from the majority of us citizens ( bar is set much lower ). Palin Entertainment services, in terms of opinion, satire…Beck-Rush-ish, …..easily granted under the Palin brand. Republicans can then honestly run clean, mudsling free campaigns ( on the surface ) while she does the dirty distraction work. Regardless of general political/public opinion, her PR/Marketing team does an excellent job, taking what we perceive as weakness ( lack of and making it her strength. Wish I could make millions being bitter and misinformed.

      this doesn’t surprise me. she wants a cut on every bobblehead and blo-up doll out there and she wants it now! what bristol could need this for drives a pang of fear into my heart, though gryphen reports that she is having a book written for her – her memoirs, but only the first 20 years. should be a short read with pop-ups.
