Open Thread – Small Things

More fun with my macro lens.  This is a piece of moss and the tiniest little fiddlehead fern (or similar flora) that I’ve ever seen.  The moss is the kind eveyrone is familiar with, and this one is about the width of a pencil eraser.  Both these little treasures were growing out of a tree stump.  Sometimes I’m glad I’m a slow hiker.

    Laws for misdemeanors and felonies differ from state to state. This is from CA law: “If someone is convicted of a misdemeanor the court can either grant or deny probation. If probation is granted, it generally lasts for up to 3 years.”

    This is not just a legal issue; it’s an employer/employee issue as well. From an employer’s perspective, I can tell you that if one or more of my new employees completely and flagrantly disregarded the training I just provided them at my expense, I would fire them immediately. This kind of behavior shows a complete lack of respect for the company they worked for and for the company’s policies and guidelines in which they were schooled.

    I get what you’re saying, Martha. I just don’t agree. 🙂 We both get to have our opinions. It is very clear to me that you are passionate about yours.. I am probably equally passionate about mine. 🙂

    I think that there has been a massive slide backwards in things it is ok to do over the years. I actually think that peeing on, in, or near, what could be considered a national landmark *should* be something that gets you in a fair bit of trouble.

    Whether it should be a felony or not, I do not know. I am fairly sure that seeing they were working there, they probably were aware that it was a felony to do so, I would expect it would be a part of their training at some point in case they saw someone doing it.

    It doesn’t matter how far something is from the boardwalk.

    Doesn’t probation mean that if they behave and don’t get into trouble for anything else, it eventually is wiped from their record?

    The USA has a tonne of bizarre laws, but it is the responsibility of each person in each state to be aware of what those laws are, and not to break them. Break them and get caught.. then people have to face the consequences.

    And yes, I do think it is a serious thing when you consider that this is a national park, and this is a tourist attraction, and this is something people come to see, and that this is on a webcam which surely these people would have been *well* aware of. They would have known this was the wrong thing to do and yet they did it. That speaks volumes to me right there.

    And if you are talking about ruining young peoples lives for something stupid.. the only people who did that were themselves – they made a choice to do this. They could have made a better choice.

    I personally am a bit sick of the laws not meeting up to the crimes. We have people over here get off on probation for *murder* or rape or child abuse. This may be a case of the punishment being a bit over the top, but frankly I prefer that to people just getting a slap on the wrist and a pat on the head from the courts.

    We all get to make choices.. make a bad one and break the law, we all know there could be consequences. Sometimes people break the law and get away with it, sometimes they get caught and have to deal with what happens as a result. We were all young once, I don’t think that meant we all went around peeing wherever we liked or breaking any laws we wanted to. 🙂 These people are adults, they are above the drinking age, and frankly their crazy child-like behaviour should have stopped by now.

    The difference would be the amount of folks around that would see you, including tons of kids. People “whipping it out” in Disney land would cause quit a sensation I’m sure. If you check out the website I included, it is more than obvious how far away Old Faithful is from the boardwalk that you are supposed to stay on. Hence the “being off trail in a restricted area “charge against them too. This is a wide open STATE PARK. It is owned by the people, not Walt Disney, thanks to Teddy Rosevelt. The same thing could be said for the statue of Liberty, considering the close proximity of people at that site. I’m sure folks have peed on the grounds there too, regardless.

    It would be the difference of stopping by the side of the road to pee, 200 miles out of town, or stopping on a city street to pee. Hullava difference.

    The point of this is the over reaction and headline news. What is really important in life, kids peeing in a geyser?

    I made that more than clear.

    Now it’s happened here, over reaction. I never said that it was “OK”. To make peeing in a geyser a felony offense, is ridiculous. Given that, I’m surprised that they weren’t charged with exposing themselves, therefore putting them on a sex offenders list.

    Consider the devastation the bankers and insurance brokers caused the US, it’s neighbors and the world……….(they’re having dinner at home and doing fine thanks, no fine, no charges, no probation), but lets ruin young folks future with felony charges for daring to “pee in a geyser”. How about some common sense and cooler heads. Whatever happened to “the punishment fitting the crime”. Fire them, fine them, ban them from the park, alright sure. 3 years probation making it a felony offense AND headline news, please. The news story spotlights just how foolish this is. What next? Lorena Bobbitt them? Does anyone really think that this was a serious premeditated crime?

    I will repeat;

    Crimes commonly considered to be felonies include, but are not limited to: aggravated assault and/or battery, arson, burglary, illegal drug abuse/sales, embezzlement, grand theft, tax evasion, treason, espionage, racketeering, robbery, murder, rape, kidnapping and fraud. Broadly, felonies can be categorized as either violent or non-violent (property, drug, white-collar) offenses.

    These are the other privileges that can be lost for “peeing in a geyser”;

    In the United States felons often face additional consequences, such as the loss of voting rights in many states; exclusion from certain lines of work and difficulty in finding a job in others; prohibition from obtaining certain licenses; exclusion from purchase and possession of firearms, ammunition and body armour; and ineligibility to run for or be elected to public office. In addition, some states consider a felony conviction to be grounds for an uncontested divorce.

    I’ve included a link to the Gov website, so you can see for yourself. There would be one hullava difference peeing in Disneyland or the Statue of Liberty!
    If they snuck in the pool would it be Gitmo and waterboarding?

    Here’s a pee story for ya. While travelling thru TX many moons ago, I stopped by the side of road because nature was calling. Walked off behind some little hills as to be out of sight. While I was doing my thing, I kept feeling moisture falling on me. At first, I thought it must be raining, but there were no clouds and the sun was hot and bright as it often is in TX. The wind was blowing.

    After I finished and stood up, I could see over the little hill I was squating behind and there was a herd of cows. The wind had been blowing bovine….on me. Definitely, one of the yuckier moments of my life. Couldn’t get to the next rest stop soon enough. I don’t think if I had gotten stopped for speeding, I would have gotten a ticket. Besides I don’t think, they could have stood the smell long enough to give me a ticket.

    Will save the story of getting wet on by a python for another day.

    Gosh, austintx, you are in the home of Austin City Limits. I really love Austin and the PBS program I mentioned. I am extremely envious of your music scene. I’ve often thought of moving back south, but the republican problem has stopped me. However, that being said, there are many of that ilk where I am, so what, really is my problem? I have found many like-minded people where I live now..it is interesting to note that Spokane county went for Obama. What a shock!

    But, then again, there are many people like you running around in Texas. Just didn’t find them when I lived there.

    Boy am I confused. Woke up at 8:32, thinking it was morning and I was just hanging out waiting for the clouds to clear and the sun to shine. But it just kept getting darker and darker, I thought, we are really in for a whopper of a thunder storm. Then it undawned on me that it was 8:32 at night…not morning. See what happens when you retire. I was having some trouble keeping up with what day of the week it was, but now having a hard time telling day from night.

    All I Saw, Thank you, too! I can hardly wait to try it. I forgot to mention that I am completely incapable of following a recipe, but the one I posted is a good base. If I am putting the tapenade on orange slices, I tend to use more olives and fewer figs because I like the way the different flavors marry, and I don’t like things too sweet. Or, you could do it like Bittman and use only olives.

    Yes, it is wonderful that transition from politics to food. Aaaahhh…good friends, good conversation, good food, wine, beer, margaritas! We have it all here on the ‘Flats!

    I cut 1 pear into chunks and did not peel it. (the skin turns a lovely maroon during baking) adding it along with the bread before soaking. I think the baquette made it perfect.

    OH! and I used a deep casserole dish with a lid (in place of the parchment) that I kept on during most of the baking time and took it off for the last 20 minutes for perfect browning.

    (I love that political chat almost always transitions into recipe chat =-)

    I just watched the video and I must say….I have to kind of go with tigerwine on this one. I really dont like Palin….and part of me enjoys it when she makes a mess of herself….but she looks and sounds like she is chilled….tired etc. Please dont get me wrong. There is no altruism in that woman..not one shred. She certainly could have been more helpful or at least she could have sounded more helpful. She is out of her depth, she has nobody to direct her…she is just way way out of her league. I think we do ourselves a disservice when we start analyzing her mental health. That is my field, and I would not ever try to analyze someone based on what I see on tv or the net.

    She is incompetent….she is unkind….she is vain….but that is all I could say with any degree of certainty.

    I prefer this on goat cheese. Got the idea for putting it on orange slices from Mark Bittman. He uses only the kalamata olives, but I decided the figs would really add to the mix.

    I don’t know so much about being “disrespectful” as I think it dumbass foolish, but $750 and 3 years probation!. Please, that is “disrespectful” to the justice system.

    As I said ,I’ve been there. Old Faithful has a huge roped off area and it is next to the original Lodge in the park. The only “items” they could possibly take “from the area” are rocks and dry grass. The reason I asked what they would do if they snuck in the a pool, is because there IS one close by.

    Thousands of visitors come to the park every year, so naturally, the area is roped off, so it won’t be trample to death.

    These young folks were pretty stupid to boot as there is a live streaming camera on Old Faithful.

    I would wager that thousands of young employees have done the very same thing, There is no harm done to the geyser whatsoever.
    You know, all young people do various silly things like that. It’s far less dangerous than taking a rifle, going joy riding and shooting road signs or a baseball bat to mail boxes. Folks in AK will know what I’m talking about. I’ve lived in rural BC too, where that is very common.

    @the problem child: Yes, I do have a problem eating first and asking questions later. There is something called shikimic acid in the fiddleheads, and they must be cooked to get rid of it. My ferns are in my backyard…ostrich ferns. I only ate a couple, so hopefully, I won’t fall over dead.

    As for your figs, I make a combination fig-kalamata olive tapenade to put over fresh orange slices drizzled with some really good olive oil. It is delicious!

    I’m envious of your bacon-wrapped scallops. More ideas for future menus.

    Interesting article…I like to look at them…I don’t know why, the Fibonacci effect??? Of nature…I can imagine how very small the one is that AKM photographed with a macro lens…beautiful, nature is beautiful. 🙂

    Please allow me to apologize for that man you saw, because I know full well what its like to be mid-stream and have a car come along and get biblical view =-) there isn’t much you can do at a moment like that and its not really fun for anyone.

    Well, he was standing right next to one of the only two roads you can take to drive down the South Coast of NSW, in peak hour with a lot of traffic about.. 😉 I don’t think he cared about anyone seeing his parts – maybe he thought it was a bonus.. 🙂 If he did care he could easily have put his back to the road.. 🙂

    Australia is a massive country too – we recently did a trip from Sydney to Cairns and there was one part of the trip where there was more than 300kms between public toilets. And yet, no peeing by the side of the road for me. I just waited till we got to the next one. You never know what could be lurking.. we have something like 7 out of the top 10 poisonous snakes in the world, a lot of nasty and evil spiders..

    Having said that, there’s a lot of times when those creatures will actually be found in the public toilets, so either way you’re taking your life into your hands..

    @130 All I Saw: Excellent points! The huge campaign coffers allow candidates to besiege the people with their version of the truth. The bigger the coffer, the more ability to sway. One of the truly saddest problems I see is that people are unable to think critically, drill down through the smokescreen, and get to genuine issues. You see politicians having to defend against personal attacks rather than deal with issues. Voters are easily sidetracked by talking points. It is a scary thing, really. I wish our election process had the playing field completely level for all candidates both in terms of finances and time spent campaigning. Like you, I think that money would be better spent on the things you mentioned. But, like you, I guess I have to get back to the real world.

    Bad enough that people feel like they can just pee anywhere they want to in this day and age.. but when you work somewhere that is a tourist attraction and you are so disrespectful as to pee on the thing that is attracting the people.. that is not good for your long term employment prospects..

    Imagine for a minute that this was not a geyser and was say.. the Statue of Liberty. Would you be ok with people who work at the Statue of Liberty peeing on it? 😉 People at Disneyland peeing on the rides? Peeing where you have to queue to get on the rides?

    Pee may be sterile, but it can and does have an odor, and often times if someone has peed somewhere eg on a building or something like that, you can smell it and it leaves a stain.

    I also have an issue with people just whipping out their *ahem* and peeing any old where.. Just last week we were out in the car driving, and by the side of the road this guy had pulled over and was having a pee, and I got a full frontal view. Yeah, just what I needed, to see someones parts as a surprise! At least he could have turn away from the road, yano?

    I can understand when it is kids needing to take a pee, but the rest of us are adults and surely capable of holding on until reaching a public or private toilet. Being that it is a tourist attraction I expect there was one within walking distance.

    It also seems like there is more to the story re missing items.

    Just my opinion.. 🙂

I had previously suggested that GINO could get away with the book based on the employee – contractor distinction, but the handbook certainly shows that the intent of the law is to treat all remunerated activity as employment (for ordinary mortals, at least).

    I’d now say that an ethics complaint is called for, if only to try to expose the DOL’s “reasoning” in giving the okay for the book.

    FOR THOSE ASKING– Salmon fishing.

    Salmon fishing is just getting started in Copper River and will be building over the next few months to a peak time of around the 4th of July for most areas.

    Bristol Bay starts with Chinook salmon around the 15th of June and Sockeye starting the end of June and into July.

    The Yukon Chinook fishery looks like it will be closed, at least to start, but we will keep updates out there as we hear.

    They do expect some Chum/Keta salmon fishing in the later part of the summer so we will be watching for that and updating.

    On buying fish direct, we do some of that but are trying to figure out a way that is easiest for people to access.

    IF you are interest in Alaskan salmon from anyone just do a search and look for companies that tell you they are based in AK. We feel it is important to buy from AK based as much of our fishing business is taken outside the state and thus jobs are lost for Alaskans.

    The first 12 hr. opener was not a large catch, and what was caught is already jetting it’s way to restaurants around the country.
    I hate to say this, but even us locals have to either get our own fish or really have a special friend/relative to get the first fish in. Even fishermen tend to bring only a small amount home–the fish are too expensive the first couple of weeks and must take advantage of the market while it is there. The fish are headed for the high end restaurants. We will be waiting for the third week when prices come down, and then we start to put up our own pack. The fishermen are busy paying their debts and costs of gearing up for the season.

    My suggestion for buying Copper River Salmon is to buy from a “direct marketer” fisherman. You can obtain names of these direct marketers at

    I have to give this one to Bristol, in Alaska correspondence courses are the norm. I have worked with our school district for many years and many student take correspondence along with regular classes. Because many students do not live near schools correspondence are the norm.
    I have had a niece and nephew from out of state who both were way behind on school, I got them through 2 grades a year with the help of correspondence classes.
    With our drop out rates in the state it is great to see these programs that do help our students when attendance at school for what ever reason is complicated.

    FYI, there is no way in heck the kid graduated without obtaining all the necessary credits the others had to. Did not happen with correspondence courses as, Palin, claims.

    Thank goodness, Wasilla high School, administrators did not allow, Palin, to exploit the 12 years of dedication by families and students who EARNED their diplomas.

    Now that Palin shown the world Bristol, is “Smarter” then, Levi…she can work and he can babysit, right.

    How did Bristol graduate high school if she missed all of the fall term and supposedly did not attend classes this spring?
    Are Alaskan laws different?
    I’m glad she did, but that must be a very liberal high school. i could not get my daughter excused from our local one missing a study at the end of the day for skating lessons? Twice a week?
    What ind of attendance policy does the high school have?

    After listening to the discussion, I find that Von Flein personifies the stereotypical characterization of the weaselly little lawyer who will do or say anything, without regard for the truth in order to garner attention for himself, his client and to make as much money as possible.

    His claims that people are simply “gnashing teeth” over the fact that Palin has followed the law and taken the wind out of the sail’s of those who wanted to file ethics complaints just because she was planning on writing a book is nothing more than propaganda designed to hype his client and feed the fans what they want to hear while attempting to chastise those who truly want an elected official to act in a legal and ethical fashion.

    His explanation that there is no reason for the AG to agree with Palin, that it was simply a matter of following the law seems to be contradicted by what the explanation of the ethics laws claim.     Okay so Palin’s Representative is acknowledging that the some complaints are not INvalid on their face. That is to say they’re getting past the first step, and being found – if true would likely be a violation of the ethics law.

    So I think its fair to say that Von Flein is aware that some complaints are not ‘frivolous.’

    Does ‘invalid on its face’ mean frivolous? Well consider the complaint about Palin getting PAC money (travel & expenses) to speak in Indiana. It was alleged that Palin was on her own time in conflict with her professional duties in Juneau. That isn’t unethical, so the complaint was dismissed, based on the premise that she was on her own time.
    However, Palins people claimed she was there on official oil& gas business too. I don’t know if that fact would change anything, but even a complaint that may be dismissed on its face, may not be far from pointing out an ethics violation.

    As for the motivation of the complainers, mmm so what! Is Alaska supposed to only accept complaints against Palin from her supporters?

    Does Von Flein have ESP and know that the “real” motivation is?

    In the interview someone claimed that the cost of processing the claims is a few million dollars, and some lawyers charge up to $300/hour.
    Thats 10,000 – 20,000 lawyer hours!

    So either the lawyers are over billing, or the claims are far more substantial than we’ve been lead to believe /and or more numerous!

    Frivolous AND wildly expensive ? …. hmmmm

    Has anyone heard of ethics complaints that have NOT been made public?

    The Repubs are meeting in a special session soon to rename the Democratic Party the Democrat Socialist Party. First, they started calling it the Democrat Party, and now they are going to tack on the word Socialist. I am so sick of Republicans. They need to find some constructive solutions for the country or get out of the way, shut up, and sit down. If the amount of hate, name calling, and totally ridiculousness that comes out of the mouths of the right wingers weren’t so disturbing, it would be laughable.

    Plus, maybe they should look at all the programs that would be considered socialist in American and decide if they are ready to give those up…Social Security,Medicaid,roads,libraries,401Ks.

    If the repubs keep going the way they are, there won’t be any need to worry about Palin running because she won’t have a party unless she creates her own. Of course, I’m sure given her many talents…moose hunter,part-time mother,part-time governor, author??,tabloid fodder (another good name for her book),attack dog,twitterer (are twitterers twats?),defender of beauty pageant contestants,correspondent for People mag…she could definitely start her own Party to Nowhere.
